JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 24-08-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner has renewed his prayer for bail in connection with Kadwa (Balia Belon) P.S. Case No.69 of 2015 dated 6.6.2015 registered under Sections 25(1-B)(a) and 26 of the Arms Act.

The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 14.12.2015 passed in Cr. Misc. No.56028 of 2015 with observation that if the trial is not concluded within six months, he would be at liberty to renew his prayer for bail.

It is submitted that the petitioner is in jail since 7th June,

Patna High Court Cr.Misc. No.35838 of 2016 (2) dt.24-08-2016 2/2 2015 and till date not a single witness has been examined on behalf of the prosecution in support of his case. Regard being had to the period already undergone in custody and the observation made by this Court in its earlier order dated 14.12.2015 the petitioner, namely, Md. Shaeed @ Babuwa @ Sahid @ Md. Shahid is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Katihar in connection with Kadwa (Balia Belon) P.S.
