JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-08-2019 This is an application for grant of anticipatory bail in connection with Triveniganj P.S. Case No. 123 of 2019, disclosing offences under Sections 379, 354B, 341, 323, 224, 504, 34 of IPC.

Prosecution story is that petitioner and other accused persons while the petitioner was constructing the wall, the same was protested by the son of the informant, on which, the petitioner and his sons came with Lathi & Danda and started assaulting his son, on hulla, the petitioner and one co-accused assaulted the informant and disrobe her and they also threatened the informant of other consequences.

Submission of the learned counsel for the petitioner is that there is land dispute between the parties and a partition suit is also going on between the parties and in that background the present case has been lodged in order to put pressure on the

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-I, Supaul, in connection with Triveniganj P.S. Case No. 123 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
