JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-07-2015 Heard learned counsels for the petitioner and the State. The petitioner being the brother-in-law of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.
The prosecution case is of killing the daughter of the informant after three years of the marriage for non-fulfilment of the dowry demand.
It is submitted by learned counsel for the petitioner that the accusation is not specific against the petitioner. The postmortem report does not reflect any external injury particularly the resisting injury and the cause of death has not been ascertained by the doctor. It is further submitted that other accused persons have been granted anticipatory bail vide Cr. Misc. No. 43653 of
Patna High Court Cr.Misc. No.26044 of 2015 (2) dt.02-07-2015 2/2 2014.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Katihar in connection with Katihar (Muffasil) P.S. Case No. 86 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
