====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 06-10-2018 Heard Sri Gajendra Kumar Singh, learned counsel for the petitioner and Sri Sunil Kumar Pandey, learned Additional Public Prosecutor.

The sole petitioner, apprehending his arrest in connection with Sherghati ( Dobhi ) P.S. Case No. 487 of 2018 , registered for the offence under Section 30(d) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender.

Learned counsel for the petitioner at the very outset has drawn my attention to the statement made in para - 3 of the petition to show that petitioner is having clean antecedent. He further submits that petitioner in the present case has been arrayed as accused on an accusation as if from the cow-shed of the petitioner there was recovery of 240 Kg of mahua flower.

Be that as it may, considering the nature of accusation and clean antecedent of the petitioner, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner / Ajay Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya / concerned court in connection with Sherghati ( Dobhi ) P.S. Case No. 487 of 2018 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure, 1973.
