The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 153(a), 295(a) of the Indian Penal Code and section 66(E)/7 of the Information Technology Act.

As per the prosecution case, petitioner used mobile no. 8905471227 and he runs face book account and also post photo and message against the communal harmony. It is submitted that petitioner has been falsely implicated in this case due to dirty village politics. No screenshot was sent by any person. No incriminating material has been collected by the Investigating Officer during course of investigation. Petitioner claims clean antecedent.

No.52639 of 2022(2) dt.20-12-2022 2/2 Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Goraul P.S. Case No. 143 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
