The petitioner seeks bail in Ara Muffasil P.S. Case No. 115/2014 corresponding to Sessions Trial No. 143/2015, registered for the offences punishable under Sections 302, 307 and other sections of the Indian Penal Code.

Prayer for bail of the petitioner was earlier rejected vide order dated 03.03.2015 passed in Cr. Misc. 50007/2014 and the Trial Court was directed to expedite the trial and conclude the same within nine months, but the trial was not concluded. The petitioner again moved before this court for his bail in Cr. Misc. 1037/2016 and the same was rejected on 29.06.2016. This is the third attempt. The report was called for from the Trial Court and the Trial Court reported that all the witnesses have already been

Patna High Court Cr.Misc. No.6803 of 2017 (5) dt.10-05-2017 2/2 examined and the trial is likely to be disposed of within two weeks.

Considering the facts aforesaid and the fact that it was the petitioner who assaulted the father of the informant on his head resulting in the death of the father of the informant, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
