The petitioner is apprehending his arrest in a case registered under Sections 272 and 273 of the Indian Penal Code and 47, 57 and 63 of the Bihar Excise Act.

Foreign liquor was recovered from Bolero vehicle, registration number whereof is mentioned in the first information report. The petitioner was not present at the time of recovery on 01.10.2016. Submission of the petitioner is that the petitioner has stated, on oath, in paragraph 7 of the petitioner that the said vehicle is not of the petitioner.

Let the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Itarhi P.S. Case No. 128 of 2016 to the satisfaction of the Chief Judicial Magistrate, Buxar, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
