The Petitioner seeks regular bail in connection with Nath Nagar P.S. Case No. 103 of 2016, registered for offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner as per F.I.R. is of misuse of the privilege of bail about six years. Submission of the learned counsel for the petitioner is that the petitioner is in jail custody since 04.05 2018 and charge has already framed against the petitioner and in total 15 witnesses, eight witnesses are yet to be examined and the petitioner has no criminal antecedent and he is in custody since

Heard learned A.P.P, who opposed the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional District & Sessions Judge, Bhagalpur in connection with Nath Nagar P. S. Case No. 103 of 2006, with condition that one of bailors of the petitioner shall be a family member, having sufficient immovable property within the jurisdiction of the concerned Court and the petitioner shall make himself available as and when required by the Court and on the event of failure on his part to appear before the Court below, his bail bond shall be cancelled.
