Petitioner seeks bail in a case registered for the offences punishable under Sections 364, 34 of the Indian Penal Code and later on Sections 302, 376, 201, 120B/34 of the Indian Penal Code has been added.

The petitioner is not named in the FIR. Petitioner has stated on oath that he has got no criminal antecedent. Submission is that the name of the petitioner had transpired in the confessional statement of co-accused Gaurav Yadav. Further submission is that Anuj Yadav whose name also appeared in the confessional statement of co-accused has already been allowed bail by a Coordinate Bench of this Court on 13.02.2017 in Cr.Misc.No. 2175 of 2017.

Patna High Court Cr.Misc. No.58930 of 2017 (3) dt.10-01-2018 Considering the aforesaid submission, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Dharhara Police Station Case No.81 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
