JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-08-2019 This application, for grant of anticipatory bail, arises out of Barauli P.S. Case No. 05 of 2019, disclosing offences under Sections 467, 468, 420, 471 and 120(B) of the Indian Penal Code.

Prosecution case is that in the light of direction of this Court in C.W.J.C. No. 15459 of 2014, the documents of several teachers, who were appointed on contractual basis, were verified and in course of enquiry, it is found that this petitioner, who was the Block Pramukh of the Selection Committee, along with other accused persons in conpsiracy have appointed the teachers having forged and fabricated certificates.

Submission of learned counsel for the petitioners is that there is no mechanism available to verify the genuineness

No.51298 of 2019(2) dt.17-08-2019 2/2 of certificate and further one of the candidates, who was appointed on the basis of forged certificates have already been enlarged on bail by a coordinate Bench of this Court 29.05.2019 passed in Cr. Misc. No. 35198 of 2018. Learned counsel appearing on behalf of Vigilance Department opposed the prayer for bail.

Having heard both sides, in view of the above facts, this application is allowed. Let petitioner, above named, surrender in the court below 26.08.2019, on which, the court below shall release her on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Barauli P.S. Case No. 05 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. It is further subject to the condition that petitioner will cooperate in the investigation and appear as and when required by the Investigating Officer.
