2. The petitioner apprehends his arrest in a case registered for the offence under Section 302/34 of the Indian Penal Code.
3. As per prosecution case, the F.I.R. named accused persons including this petitioner strangulated the sister of informant to death.
4. Petitioner is son of the deceased. The deceased and her husband were having four children. It further transpires that some altercation took place between them and out of anger, mother of petitioner committed suicide. The post-mortem report also goes to show that cause of death is Asphyxia due to hanging. Similarly situated co-accused have already been granted anticipatory bail by a coordinate Bench of this Court,
Patna High Court CR. MISC. No.51529 of 2025(5) dt.11-12-2025 2/2 vide order dated 21.02.2025 passed in Cr.Misc. No. 4738 of 2025. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran in connection with Kotwa P.S. Case No. 68 of 2024, subject to condition as laid down under Section 438(2) of the Cr.P.C. / Section 482(2) of the B.N.S.S.
