Petitioner seeks bail in connection with Fatuha P.S. Case No. 208 of 2016 registered under Sections- 498A, 363/34 of the Indian Penal Code.
Informant has alleged that her daughter was being tortured and assaulted by her in-laws due to non-fulfillment of demand of dowry. It is further alleged when she went to her sasural she found that her daughter was missing. She has suspected that accused persons might have committed some misfortune with her daughter.
Learned counsel for the petitioner submits that the victim was a lady of unsound mind. She went away with the
Patna High Court Cr.Misc. No.48605 of 2016 (4) dt.09-02-2017 2/2 informant and since then she is traceless. The informant in order to save her skin has lodged the present case. Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that petitioner is the husband and there is allegation of torture and assault due to nonfulfillment of demand of dowry. Considering the facts and circumstances of the case and the submissions advanced on behalf of the State, I do not feel inclined to grant the privilege of bail to the petitioner. His prayer for bail is, therefore, rejected.
