This application for regular bail arises out of Excise Case No.373 of 2018 for the offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

Allegedly, 360 bottles of foreign liquor (108 litres) was recovered from a motorcycle, in which the petitioner was the pillion rider.

Learned counsel for the petitioner has submitted that for the first time the petitioner has been made an accused in a case under Section 30(a) of Bihar Prohibition and Excise Act, 2016. He has also submitted that if the petitioner is found involved in future in similar type of offence, the petitioner's bail may be liable to be cancelled, if he is granted bail in the present case.

Let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, East Champaran at Motihari, in Excise Case No.373 of 2018.
