The petitioner seeks bail in Raxaul P.S. Case No. 190/2016, registered for the offences punishable under Sections 47 and 54 of the Bihar Excise (Amendment) Act, 2016. 50 bottles of 300 m.l. Nepali country-made wine was recovered from the possession of the petitioner and for that the petitioner is in jail since 03.09.2016. Petitioner has already remained in jail for about four months for recovery of only 15 litres of country-made wine.

Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like

Patna High Court Cr.Misc. No.52988 of 2016 (2) dt.10-01-2017 amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Raxaul at Motihari in connection with Raxaul P.S. Case No. 190/2016.
