The petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a, 26, 35 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 16.12.2020, charge-sheet has been submitted in this case and has antecedent of one case. Allegation is of recovery of a country-made rifle with a magazine without bolt from the house of the petitioner. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. The house is a joint family property and as such, petitioner was not aware, who had kept the arms in the house. The learned counsel

Patna High Court CR. MISC. No.62718 of 2021(2) dt.25-03-2022 2/2 further submits that petitioner has remained in custody for more than 15 months.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in this case , the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Chainari P. S. Case No.242 of 2020, subject to condition that one of the bailors shall be the father-in-law of the petitioner namely, Dhruv Chaudhary.

The application stands allowed.
