Petitioner seeks bail in connection with Raxaul P.S. Case No. 89 of 2016 registered under Sections- 25(1b)a/26/27 and 35 of the Arms Act. Petitioner and others were caught by the police when they made attempt to take forcible possession of a land. Learned counsel for the petitioner submits that petitioner is license holder of the arms which have been recovered from his possession. It is further submitted that similarly situated co-accused persons have been granted bail by this Hon'ble Court vide Cr. Misc. Nos. 30928 of 2016, 34126 of 2016, 39014 of 2016, 41992 of 2016, 39132 of 2016 and

Patna High Court Cr.Misc. No.52958 of 2016 (2) dt.14-12-2016 39208 of 2016.

Considering the facts and circumstances of the case and the fact that similarly situated accused persons have been granted bail by this Court, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Raxaul at Motihari in connection with Raxaul P.S. Case No. 89 of 2016.
