JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-11-2025 Heard learned counsel appearing on behalf of the petitioners, learned APP appearing on behalf of the State and learned counsel for the complainant/Opposite Party No. 2.
2. The petitioners apprehend their arrest in a complaint case registered for the offence punishable under Sections 341, 342, 323, 307, 406, 468A and 34 of the Indian Penal Code.
3. As per prosecution case, the complainant got married with one Ramvinay Singh on 31.05.2012 and thereafter, husband of the complainant died on 15.04.2020. It is alleged that after death of her husband, all the accused persons named in
Patna High Court CR. MISC. No.51595 of 2025(3) dt.20-11-2025 2/3 the complaint petition, including these petitioners, started committing torture and harassment with the complainant and tried to kill her by pressing her neck and thereafter, all the accused persons snatched the belongings of the complainant and ousted her from her matrimonial house.
4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. Petitioners are none else than brother-in-laws of the complainant and as a matter of fact, the complainant wanted partition in ancestral property and due to property dispute, this false and concocted case has been lodged only with a view to put pressure upon the petitioners. At no point of time, these petitioners committed any torture or harassment with the complainant. Petitioners claim clean antecedents.
5. Learned A.P.P. for the State and learned counsel for the complainant have vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
6. Considering the facts and circumstances of the case, relationship between the parties, nature of accusation and clean antecedents of the petitioners, the prayer for grant of anticipatory bail to the petitioners is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sikarahana at Dhaka, East Champaran, Motihari in connection with Complaint Case No. C282 of 2022, subject to condition as laid down under Section 482(2) of the B.N.S.S..
