JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-06-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Sour Bazar (Patarghat O.P.) P.S. Case No. 516/2014 registered under Sections 341, 323, 324, 427, 379, 504, 506 and 34 of the Indian Penal Code.

The accusation is that on 14.11.2014, father of the informant went to see the labourers in the field where he saw that she-goat of daughter of Md. Sulo was grazing the crops and the father of the informant slapped the girl who was gazing the crop. Thereafter, Md. Sulo and the petitioner alongwith others came running having weapons in their hands and assaulted the father of the informant and threatened him to kill. On hearing hulla, cousin

Learned counsel for the petitioner submits that petitioner and informant are co-villagers and the petitioner is innocent and has falsely been implicated in this case. It is further submitted that the injury of the father of the informant is simple in nature. Considering the aforesaid submissions, let the above named petitioner be released on anticipatory bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Saharsa in connection with Sour Bazar (Patarghat O.P.) P.S. Case No. 516/2014, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
