ANJANA MISHRA ORAL ORDER 03-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 02.04.2019, in connection with Ishakchak P.S. Case No. 52 of 2019 for the offences under Sections 188, 272, 273, 420/34 of the Indian Penal Code and 27(b)(ii), 27(b)(d), 28, 28(a), 36AC, 30A, 30B, 30C of Drugs & Cosmetic Act, 1940 & Amendment 2008. Learned counsel for the petitioner submits that the alleged recoveries were not made from the conscious possession of the petitioner but near a peepal tree towards the east of the vegetable market. The petitioner has falsely been implicated in the present case. The petitioner has one criminal antecedent in which he has already been enlarged on bail.

Considering the aforementioned facts and

No.56451 of 2019(3) dt.03-12-2019 2/2 circumstances, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur, in connection with Ishakchak P.S. Case No. 52 of 2019.
