Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner seeks bail in a case instituted under Sections 147, 149, 341, 323, 324, 326 and 504 of the Indian Penal Code.
It is alleged that the petitioner gave farsha blow over the head of the informant, due to which, he fell down. Thereafter co-accused Pramod Yadav gave tangi blow on the forehead of the informant and when his cousin brother went to save him, he was assaulted with farsha blow by the petitioner on his left hand.
Patna High Court Cr.Misc. No.269 of 2017 (2) dt.10-01-2017 2/2 Thereafter the informant was taken to hospital for treatment. It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.11.2016. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. It is a case and counter case between the parties. Both the parties are agnates. The alleged occurrence is said to have been taken place due to property dispute.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st class, Jamui, in connection with Laxmipur (Gidhaur) P.S. Case No. 104 of 2016.
