JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 06-08-2019 This application for anticipatory bail arises out of Delha P.S. Case No. 09 of 2019 for the offence under Sections 341, 323, 342, 354(B), 509, 414 and 506/34 of the Indian Penal Code.

It appears that the petitioner had applied for anticipatory bail, giving rise to A.B.P. No. 1401/19/61/19, which has been dismissed by the learned A.D.J.-II, Gaya, vide order dated 14.05.2019 on the ground that the petitioner had filed another anticipatory bail application, registered as A.B.P. No. 1013/19, which was pending in the Court of learned Sessions Judge, Gaya. The petitioner, in that background, withdrew the anticipatory bail application and accordingly A.B.P. No. 1401/19/61/19 stood dismissed by order dated 14.05.2019. Learned A.D.J.-II, Gaya, has noted that the petitioner filed two anticipatory bail applications and furnished false

Patna High Court CR. MISC. No.49009 of 2019(2) dt.06-08-2019 2/2 certificate. Conduct of the petitioner disentitles him from consideration of his application for anticipatory bail. This application is accordingly dismissed.

The petitioner is directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
