The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 394/34, 302 of the Indian Penal Code and Section 27 of Arms Act. The allegation is regarding two unknown accused persons having intercepted the son of the informant while he was coming from the bank, thereafter they had snatched a sum of Rs. 2,30,000/- and had murdered the son of the informant.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.52840 of 2022(2) dt.14-02-2023 2/3 petitioner that the petitioner is innocent and he has falsely been implicated in the present case. Neither the petitioner is named in F.I.R. nor he has been put on T.I. Parade. There is no any witness to show the involvement of the petitioner in the alleged offence. The name of petitioner sprang up on the confessional statement of one Md. Danish. It is also submitted that petitioner is languishing in judicial custody since 28.03.2022. Similarly situated several co-accused persons have been granted Bail by the co-ordinate Benches of this Court. Learned APP appearing for the State has vehemently opposed the prayer for Bail.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Tajpur P.S. Case No. 401 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with
