The petitioner seeks bail in a case instituted under Sections 379 and 411 of the Indian Penal Code. The prosecution story, in brief, is that laptop, mobile and ornaments are said to have been stolen from the house of the informant and the petitioner along with other co-accused were seen with the alleged stolen articles.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.08.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused merely on suspicion. There is no eyewitness to the

Patna High Court Cr.Misc. No.311 of 2017 (2) dt.10-01-2017 2/2 alleged occurrence. There is no recovery of any incriminating article from the possession of the petitioner. On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Birpur, Supaul, in connection with Birpur P.S.
