ANJANA MISHRA ORAL ORDER 21-07-2015 Heard learned counsel for the petitioner and learned counsel for the State as well as learned counsel for the informant. The petitioner apprehends his arrest in connection with Runnisaidpur P.S. Case No. 411 of 2014 registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has been implicated in the present case only on the basis of suspicion. He submits that it was a case of love affair between
Patna High Court Cr.Misc. No.27429 of 2015 (2) dt.21-07-2015 2/2 one Mobin Azad and the informant's sister. It is further submitted that both Mobin Azad and the girl in question have eloped. It is also submitted that similarly situated co-accused Nathuni Sah @ Rajesh Kumar Gupta as well as petitioner's wife granted privilege of anticipatory bail in Cri. Misc No. 3665/15 and Cri. Misc. No. 3467/15 vide order dated 21.4.2015.
Considering the aforementioned submissions and also the fact that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi in connection with Runnisaidpur P.S. Case No. 411 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) sushma/- U T
