JUSTICE PRABHAT KUMAR JHA ORAL ORDER 09-10-2015 Heard the learned counsel for the petitioners, the learned counsel for the informant and the learned Additional Public Prosecutor.

The petitioners apprehend their arrest in a case under Section 307 and other sections of the Indian Penal Code. Pachhi Singh and Chhatu Singh are alleged to have assaulted Putul Devi, the mother of informant, on her head and thumb. Rudal Singh and Anil Singh are alleged to have assaulted Fudal Singh, the father of informant. No specific allegation of assault is made against the petitioners although the petitioners are alleged to have assaulted the mother and father of the informant

Patna High Court Cr.Misc. No.27343 of 2015 (4) dt.09-10-2015 2/2 but from perusal of the injury report, it appears that mother and father of informant each got two injuries which were attributed to Pachhi Singh, Chhatu Singh, Rudal Singh and Anil Singh respectively. The petitioners are agnates of the informant. On the other hand, the learned counsel for the informant vehemently opposed the prayer for anticipatory bail. Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Bhagalpur in Shahkund P.S. Case No. 53 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
