The petitioner seeks bail in a case registered for the offences under Section 376, 307, 504, 506 of the Indian Penal Code and Section 67 and 67A of the Information Technology Act.
The learned counsel for the petitioner submits that the petitioner is in custody since 15.07.2021, he is a person with clean antecedent, charge-sheet has been submitted in this case. The learned counsel for the petitioner submits that the informant alleges that she was in love with the petitioner before marriage as they had come close through wts. up and even has established physical relation with the petitioner but the

No.62394 of 2021(2) dt.23-03-2022 2/3 informant on 13.02.2019 got married, the petitioner got angry and with a view to disturb her married life, the petitioner sent some intimate photo of the informant to her husband, further had threatened informant that her husband would be killed. The learned counsel for the petitioner submits that petitioner has been falsely implicated in this case, he has not sent any photograph of the informant to her husband, the informant with a view to extort money from the petitioner has instituted the present false case. The learned counsel further submits that there was absolutely no physical relation between the petitioner and the informant.
The learned A.P.P. opposes the bail application and submits that it is an admitted position that the informant got married on 13.02.2019 to a different person, further the informant admits that she was in love with this petitioner prior to marriage and even had established physical relation. The learned APP further submits that no woman would want to get her married life disturbed by making such frivolous allegation, the learned APP further submits that the man whom the informant love betrayed her and at the same time has brought disrepute to the informant.
Considering the submissions made by learned APP,
