JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-09-2019 Earlier the prayer for anticipatory bail of the petitioner was dismissed vide order dated 07.08.2018 passed in Cr. Misc. No. 45739 of 2018 and allegation against the petitioner is of causing death of his wife for non fulfilment of demand of dowry.

Submission of learned counsel for the petitioner is that he is armed forces personnel and he has falsely been implicated in this case.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case and also the fact that the prayer for grant of anticipatory bail of the petitioner has already been dismissed on merit, I am not inclined to grant the privilege of

Patna High Court CR. MISC. No.56509 of 2019(3) dt.18-09-2019 2/2 anticipatory bail to the petitioner, he may surrender in the court below and pray for regular bail, which will be disposed of by the court below on the merit of the case as well as on the basis of materials available in case diary.

This application is accordingly dismissed.
