JUSTICE SANJAY PRIYA ORAL ORDER 08-10-2018 Supplementary affidavit has been filed on behalf of petitioners stating therein that petitioner no. 1 is also involved in one another case.

Heard learned counsel for the petitioners, informant and the learned A.P.P. for the State.

The petitioners seek bail in Khagaria (Muffasil) P.S. Case No. 207/2018, instituted for the offences under Sections 147, 148, 149, 448, 341, 323, 307, 302 and 379/120B of the Indian Penal Code read with Section 27 of Arms Act.

It is alleged in the written report that the petitioners along with other 21 persons surrounded the house of informant and on the order of Atmaram Yadav, co-accused Ashok Yadav

Patna High Court Cr.Misc. No.59756 of 2018 (2) dt.08-10-2018 2/2 opened fire, which hit the Bhavo of informant in her abdomen, who died.

As such, there is general and omnibus allegation against these petitioners.

Learned counsel for the informant has opposed the prayer for bail of the petitioner.

Considering the aforesaid fact and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Muffasil) P.S. Case No. 207/2018, subject to the conditions that both the bailors shall be the close relative of the petitioners. (Sanjay Priya, J.) Rakhi U T
