JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-07-2015 Heard learned counsel for petitioner and learned Additional Public Prosecutor for the State.

Petitioner apprehends his arrest in connection with Mahkdumpur P.S. Case No. 14 of 2015 registered for the offence under Sections-467, 408, 471, 419, 420 of the Indian Penal Code. Petitioner happens to be son of local Mukhiya and from perusal of the first information report itself, I find that the only allegation against him is that he accompanied his father and other beneficiaries up to the bank and moreover, the first information report reflects that it was co-accused, Abhishek Anand, who withdrew the amount and kept with him, which was later on, said to be given to the beneficiaries. Considering the aforesaid facts and circumstances

Patna High Court Cr.Misc. No.26187 of 2015 (2) dt.16-07-2015 2/2 as well as submission of the parties, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mahkdumpur P.S. Case No. 14 of 2015 to the satisfaction of Chief Judicial Magistrate, Jehanabad subject to conditions as laid down u/S 438(2) of the Cr. P.C.
