Petitioner prays for bail in connection with Khudwan P.S.Case No. 30 of 2018 registered for the offences punishable under Sections 341, 323, 379, 498A/34 of the Indian Penal Code and Sections 3 & 4 of Dowry Prohibition Act.
Allegation against the petitioner is of making cruelty and torture to his wife and also snatching her ornaments. Submission of learned counsel for the petitioner is that petitioner is still ready to keep her and he is in custody since 24.8.2018 and charge sheet has already been submitted in this case
Patna High Court Cr.Misc. No.63631 of 2018 (2) dt.26-10-2018 2/2 and he is ready to abide by any condition that may be imposed on him.
Heard learned APP and learned counsel for the informant, who has opposed the prayer for bail stating that she was subjected to cruelty and further petitioner has performed second marriage with another lady.
Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Daudnagar (Aurangabad), in connection with Khudwan P.S.Case No. 30 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that he has to co-operate in disposal of trial and appear before the court as and when required, otherwise his bail bond shall be cancelled.
