JUSTICE BIRENDRA KUMAR ORAL ORDER 13-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 328/376/34 of the Indian Penal Code and Sections 3/4 of the of the Prevention of Children from Sexual Offences Act, 2012.

The petitioner was tenant in the house of the informant. The petitioner is a married person living along with his family in the said house. On the alleged date of occurrence when the informant returned back to his house he found that his son Shivam and daughter Ragani were lying unconscious. Victim girl stated before the police that she was administered some stuffying substance suspiciously in her food by the petitioner and his wife.

No.52197 of 2016 (4) dt.13-01-2017 2/2 As a result of taking that food by her brother, he became unconscious and she also became unconscious after taking the same food subsequently. The medical report from a private doctor does not reveal any case of any poisonous substance administered; rather the doctor has reported a case of sexual assault, which is not the allegation of victim Ragini. Petitioner is in custody since 18.06.2016.

Considering the suspicious nature of material, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Saran at Chapra/Successor Court, in connection with Ekma P.S. Case No. 117 of 2015.
