JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 06-10-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Obra P.S.Case No. 179 of 2018 registered under Sections 30(a),30(d), 30(e), 30(g)/3(ii) of the Bihar Prohibition and Excise Act, 2016.

The police are said to have received certain information in respect of preparing and selling of country made liquor by coaccused Dhananjay Choudhary in his house. A raid was conducted accordingly and certain articles were seized. The petitioner was found sleeping in the said house and he is said to be full-brother of Dhananjay who is an accused. Learned counsel appearing on behalf of the petitioner contends that petitioner has been implicated only because he was found sleeping in the house though there is allegation

Patna High Court Cr.Misc. No.61926 of 2018(2) dt.06-10-2018 2/2 against his brother Dhananjay Choudahry of his involvement in preparation and sale of country made liquor. She contends that no recovery has been made from the room where the petitioner was found sleeping by the police. It has been stated in paragraph-3 of the application that the petitioner has no criminal antecedent.

Considering the above submission, this application is allowed. The petitioner, named above, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VII Cum Special Judge (Excise), Aurangabad in connection with Obra P.S. Case No. 179 of 2018.
