The petitioner is languishing in custody for the offences punishable under Sections 420/406 of the Indian Penal Code.
The FIR would reveal that main allegation of cheating to the complainant is against co-accused Bablu Ansari, who is full-brother of this petitioner. The complainant had deposited money on the dictate of Bablu Ansari in the bank account of Bablu Ansari as well as his construction company. Learned counsel for the informant opposed the prayer for bail on the ground that the said construction company is of the four brothers. Hence, they all were involved

Submission is that the petitioner has stated on oath that he has had no concern with the act of co-accused Bablu Ansari or his construction company. The petitioner is living separately from Bablu Ansari.
Considering the fact that there is no direct allegation against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Chenari P.S. Case No.83 of 2019, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
