JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 409, 420, 34 of the Indian Penal Code. The informant has alleged that the petitioner being Shaka Dakpal, Musahari Branch Post Office in collusion with other co-accused persons defalcated Rs. 3,10,162/- fraudulently making financial irregularities in the post office. It has been submitted on behalf of the petitioner that it has been alleged that the total amount of defalcation is Rs. 3,10,162/-. By way of supplementary affidavit it has been brought on record that the petitioner has already deposited an amount of Rs.1,03,000/-.
On behalf of the State, it has been submitted that
Patna High Court Cr.Misc. No.26689 of 2015 (2) dt.21-07-2015 2/2 the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Gopalganj in connection with Vijaipur (Bijaipur) P.S.Case No. 34 of 2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
