JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-10-2016 Heard learned counsels for the petitioners and the State. The petitioners being parents of the husband of the complainant are apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code.

The basic accusation is of torture. It is alleged that earlier the complainant was ravished by the son of the petitioners namely Tulsi Sah leading to registration of Meerganj P.S. Case No. 68 of 2013 under section 376 IPC but subsequently Tulsi Sah married with the complainant hence the complainant did not depose against Tulsi Sah and others as a result he got acquitted but after acquittal in the case lodged by the complainant the torture

Patna High Court Cr.Misc. No.45958 of 2016 (2) dt.21-10-2016 2/2 was inflicted.

It is submitted by the learned counsel for the petitioners that the accusation is omnibus and general against the entire inlaws family and the thrust of accusation is against the husband of the complainant namely Tulsi Sah.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Purnea in connection with Complaint Case No. 2948 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
