JUSTICE SUDHIR SINGH ORAL ORDER 21-10-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 302,201, 120B/34 of the Indian Penal Code. The allegation against the petitioner is that he along with other FIR named accused persons killed Bambam Singh and Gholtan Singh after making conspiracy and plan. Co-accused Rabish Kumar and Prem Kumar called the son of the informant and they taken away Bambam Singh, and after drinking together killed Bambam Singh and Gholtan Singh and threw the dead body in Koelwa Diyara.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 09.06.2016. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner
Patna High Court Cr.Misc. No.45857 of 2016 (2) dt.21-10-2016 2/2 has falsely been implicated in the present case. There is no substantive evidence to suggest the implication of the petitioner in the present case. Other co-accused have been granted bail by a coordinate bench of this Court in Cr. Misc.No. 41929 of 2016 and Cr. Misc.No.17367 of 2016.
It has been submitted on behalf of the State that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Lakhisarai in connection with Pipariya P.S.Case No. 58 of 2015.
