Petitioner, who is in custody, seeks bail in connection with G.O. Case No. 419 of 2018 arising out of Laheriasari P.S. Case No. 227 of 2018 registered for the offences punishable under Sections 30(a) of the Bihar Excise Amendment Act.

Informant who is the police officer has sated that on secret information he along with other police personnel raided and recovered huge quantity of illegal foreign liquor from bolero pick-up van.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been

Patna High Court Cr.Misc. No.63343 of 2018(2) dt.29-10-2018 2/2 falsely implicated in this case. Nothing has been recovered from his possession. He is not named in FIR. Name of the petitioner has surfaced in this case only on the basis of confessional statement of co-accused, namely, Md. Pinku and except this confession there is nothing against him. He has no criminal antecedent. He is in custody since 25.07.2018. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J 4th-cum-Special-Judge, Excise Act, Dharbhanga in connection with G.O. Case No. 419 of 2018 arising out of Laheriasarai P.S. Case No. 227 of 2018.
