JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 13-02-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner seeks bail in connection with Saraiya P.S. Case No. 295 of 2016 registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code. Allegedly, the petitioner along with co-accused Sonu Kumar, Rupesh and Vikash kidnapped the minor daughter of the informant aged about 16 years. During investigation, the victim girl was recovered and her statement was recorded under Section 164 of the Code of Criminal Procedure wherein the victim girl has not levelled any specific allegation of overt act against the petitioner and the petitioner is in custody since 05.09.2016. In the facts and circumstances stated above, the petitioner is

No.54668 of 2016 (4) dt.13-02-2017 2/2 directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, West Muzaffarpur in connection with Saraiya P.S. Case No. 295 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
