The petitioner apprehends his arrest in a case registered for the offence under Sections 272, 273 of the I.P.C. and Section 30(a) of Bihar Prohibition and Excise Act. 105 liters of spirit has been recovered from a mango orchard, behind the house of petitioner.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Recovery has been made from an open place. Petitioner claims clean antecedent.

Considering the nature of allegation and clean antecedent of petitioner, let the above named petitioner, in the

Patna High Court CR. MISC. No.52323 of 2022(2) dt.11-11-2022 2/2 event of his arrest or surrender within a period of six weeks from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1, East Champaran, Motihari in connection with Turkauliya P.S. Case No. 889 of 2021, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
