1. Heard the parties.

The present writ application has been filed for a direction to the District Magistrate-cum-Collector, Vaishali at Hajipur to consider the claim of the petitioner regarding discrepancy in the E-Posh machine provided to him from the tagged dealer namely late Baldeo Das having P.D.S. License No. 86 / 2016.

3. Learned counsel for the petitioner submits that the father of the petitioner late Fakira Singh was granted license for running P.D.S. dealership in the Gram Panchayat - Sherpur

Patna High Court CWJC No.12187 of 2025(2) dt.18-11-2025 2/3 Manikpur, Village- Mohanpur, Block- Mahua. After the death of the petitioner's father, his P.D.S. shop was tagged with the shop of the then vendor Baldeo Das. In the meanwhile, the petitioner has been granted P.D.S. shop dealership in September, 2024 having license no. 06 / 2024. After grant of license to the petitioner, the E-Posh machine was provided from the tagged dealer Baldeo Das on 17.10.2024, however, the E-Posh machine was having the data showing foodgrains which was allotted to previous dealer Baldeo Das to the extent of 214.49 quintal of wheat, 900.64 quintal of rice, out of which Baldeo Das has provided 91.74 quintal of wheat and 265.55 quintal of rice. However before the entire foodgrain could be settled with Baldeo Das he also died as such 122.

96 quintal of wheat and 635.20 quintal of rice is still showing as outstanding in the EPosh machine of the petitioner which was never supplied to him and the petitioner has no liability about the aforesaid quantity of wheat and rice. He further submits that a detailed representation has been filed through e-mail on 24th April, 2025 before the District Magistrate, Vaishali at Hajipur which is still pending.

4. Learned counsel for the State submits that District Magistrate -cum-Collector, Vaishali at Hajipur may be directed to look into the matter and dispose the representation of the

Having heard learned counsel for the parties, considering the nature of prayer and the fact that in the E-Posh machine the foodgrain was loaded from before which was being used by the tagged dealer, accordingly, I direct the District Magistrate-cumCollector, Vaishali at Hajipur to look into the matter and consider the representation of the petitioner and pass a reasoned order within a period of three months from the date of receipt / production of a copy of this order.

6. With the aforesaid observation and direction, the present writ application is disposed of.
