The petitioner seeks bail in a case registered for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 28.125 litres foreign liquor was recovered from a Bolero vehicle. It is contended that petitioner's name has cropped up in this case on the statement of co-accused, Ashok Yadav, who was apprehended from the spot. It is urged that only on the basis of suspicion, the petitioner has been made accused in this case as no incriminating article was recovered from his possession. Petitioner claims that he is having clean antecedent and is in custody since 29.08.2018.

No.62248 of 2018(2) dt.08-10-2018 2/2 Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna in connection with Barh P.S. Case No. 290/2018, Special Case No. 7328/2018. Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
