Petitioner apprehends arrest in a case registered for the offences punishable under Sections 307, 379/34 and other sections of Indian Penal Code.

As per F.I.R., this petitioner caught the informant and thereafter, co-accused Raju Ram inflicted iron blow on the informant.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and there is no allegation of overt act against him and he is only alleged to have caught the informant.

Considering the fact that there is no allegation of overt act, let the above named petitioner in the event of his

No.53216 of 2022(2) dt.20-12-2022 2/2 arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VI, Siwan in Pachrukhi Sarai P. S. Case No. 89 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
