JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 353 and 504/34 of the Indian Penal Code.
It is alleged that when the Circle Inspector of Makhdumpur went to demarcate the land for the proposed building of Agan Barhi Centre at village Sarthua on the direction of high officials then the petitioners abused and assaulted the informant.
It is submitted by learned counsel for the petitioner that the FIR was registered on 01.04.2015 but the same reached to the court of learned In-charge CJM on 03.04.2015 which reflects that by antedating, the FIR has been lodged and there is nothing on
Patna High Court Cr.Misc. No.26589 of 2015 (2) dt.03-07-2015 2/2 record to suggest that any injury was caused to the informant. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Jehanabad in connection with Makhdumpur P.S. Case No. 91 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
