JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-07-2015 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the complainant is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 498A of the Indian Penal Code. The basic accusation is of torture. The marriage between the petitioner and complainant is admitted fact. It is submitted by learned counsel for the petitioner that when the anticipatory bail application of the petitioner was pending before the learned District and Sessions, report was called for from the Baunsi police station and the report was submitted by S.H.O., Baunsi Police station before the learned District and

Patna High Court Cr.Misc. No.26587 of 2015 (2) dt.03-07-2015 2/2 Sessions Judge on 19.02.2015 to the effect that the complainant has married with one Md. Nawab and the mother of Md. Nawab has also admitted this fact.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Araria in connection with Complaint Case No. 88C of 2010, subject to the conditions as laid down under Section 438(2) Cr.P.C.
