JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-08-2019 This application, for grant of anticipatory bail, arises out of Parbatta P.S. Case No. 10/2019, disclosing offences under Sections 341, 384, 504, 506/34 of the Indian Penal Code.

Allegation as per F.I.R. is that while the construction of drain was going on under Nischay Yojna, co-accused Suman Sharma, son of the petitioners went there and started threatening the JCB drivers and demanded money, which was informed to the informant and when he went there he was also threatened. Submission of learned counsel for the petitioners is that there is no allegation against these petitioners, who happen to be mother and father of the co-accused Suman Sharma and

Patna High Court CR. MISC. No.50769 of 2019(2) dt.16-08-2019 2/2 only because they are mother and father of the said co-accused, they have falsely been made accused in this case. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-I, Khagaria, in connection with Parbatta P.S. Case No. 10/2019, subject to the condition laid down under Section 438

(2) of the Code of Criminal Procedure.
