The petitioner apprehends his arrest in a case registered for offences punishable under Section 379 of the Indian Penal Code and Section 40 of the Mining Act.
Learned counsel for the petitioner submits that ingredients of Section 379 of the I.P.C. are not made out and provisions of Mining Act are bailable. It is contended that petitioner was driver and has not in the trade of extracting and transporting sand.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail in the
Patna High Court Cr.Misc. No.37816 of 2016 (2) dt.17-09-2016 2 / 2 event of arrest/surrender before the court below within a period of six weeks from today in Baghaila P.S. Case No. 17 of 2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sub-Judge-IX-cum-A.C.J.M., Sasaram, Rohtas subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
