The petitioner is languishing in custody since 31.05.2019 in a case for the offence registered under Sections 413 and 414 of the IPC.

The prosecution story, in brief, is that on secret information, the informant caught hold three persons alongwith Motorcycles. They disclosed that Sanjeev Kumar, Deepak Kumar @ Golu and Suddu Rai (petitioner) having the theft Motorcycles. Thereafter, the informant apprehended Deepak Kumar @ Golu and Sanjeev Kumar. On disclosure made by Deepak Kumar @ Golu and Sanjeev Kumar, the police arrested Suddu Rai @ Sudan Jee (petitioner) and recovered a stolen Motorcycle from his house.

There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner had no knowledge that the Motorcycle in question is a stolen property. He has been made accused in the present case due to mistake of fact. On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- 1, Danapur at Patna and successor/concerned court, in connection with Danapur P.S.
