The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341/323/447/448/307/34of the Indian Penal Code and 25(1-B)a, 26 of the Arms Act.
It is alleged that the petitioner tried to crush the informant through a tractor but the informant saved himself by entering into the house. It is further alleged that the accused persons flee away leaving the truck near brick kiln and from the truck one country made pistol was recovered.
It is submitted by learned counsel for the petitioner that the accusation has been levelled in the background of Title Suit No.318 of 2007 between the parties and no recovery has been
Patna High Court Cr.Misc. No.26825 of 2015 (2) dt.21-07-2015 2/2 made from the petitioner. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Deoria P.S. Case No.30 of 2015, pending before the learned Chief Judicial Magistrate, Muzaffarpur.
With the above observation, this application is, accordingly, disposed off.
