The petitioner seeks bail in a case registered for offences punishable under Sections 30 (a) and 37(b) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 2 litres of country-made liquor was recovered from the possession of the petitioner in a garden. It is contended that nothing has been recovered from the conscious possession of the petitioner and he has been falsely implicated in the present case. Petitioner claims that petitioner has no concern with the garden and the seized liquor. Petitioner claims that he is having clean antecedent and is in custody since 02.09.2018.
Patna High Court Cr.Misc. No.61812 of 2018(2) dt.08-10-2018 2/2 Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on his furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Act, Patna, in connection with Special Case No. 8063 of 2018 arising out of Sigori P.S. Case No. 66 of 2018.
If the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
