JUSTICE RAKESH KUMAR ORAL ORDER 22-12-2016 Heard Sri Rajesh Ranjan Kumar, learned counsel for the petitioner and learned Additional Public Prosecutor . The sole petitioner, who is in custody only since 12.7.2016 in Hajipur Town P.S. Case No. 475 of 2016 registered for the offence under Section 399, 402, 414, 467, 420, 472, of the Indian Penal Code, Section 25 (1-B)A , 26 and 35 of the Arms Act and Section 20 and 22 of the Narcotic Drugs And Psychotropic Substances Act has prayed for grant of bail. It was submitted by learned counsel for the petitioner that from possession of the petitioner no sort of contraband articles were recovered. Only recovery of one country made pistol and cartridge was shown to be recovered from possession of the petitioner. It was accepted that from some of the other accused

Patna High Court Cr.Misc. No.48437 of 2016 (2) dt.22-12-2016 2/2 persons few smaller quantity of Ganja rapped in papers was recovered.

Considering the nature of accusation as well as the fact that petitioner was earlier also made an accused as stated in paragraph no. 3 of the petition, presently I am not inclined to extend the privilege of bail.
